Terms of Service

Please read these Terms of Service ("Terms") carefully before using the GoGBA mobile application ("App") operated by us ("we", "our", or "us").

1. Acceptance of Terms

By downloading, installing, or using GoGBA, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

GoGBA is a Game Boy Advance (GBA) game emulator application that allows you to play GBA games on your mobile device. The App provides emulation functionality using the libretro mGBA core. Additional features include an optional Premium upgrade (in-app purchase on iOS/Android) that unlocks Cloud Save, enabling you to sync game save files across devices via Google Drive or iCloud. A separate optional AI Screen Translation subscription (in-app purchase) may be available; when purchased and activated, it sends captured game screen images to Google's AI services to generate translations. That subscription may be subject to usage limits (for example, a per-day cap) that we can adjust via remote configuration; limits in effect are those implemented in the App and are not a guarantee of unlimited use. 3. Legal Use and ROM Files

3.1 ROM Ownership

You are solely responsible for ensuring that you have the legal right to use any ROM files you load into GoGBA. You must only use ROM files for games that you legally own.

3.2 Copyright Compliance

Downloading, distributing, or using ROM files for games you do not own is illegal and violates copyright laws. We do not provide, distribute, or facilitate access to ROM files. You are responsible for obtaining ROM files legally.

3.3 Our Position

GoGBA is provided as an emulation tool. We do not endorse or encourage piracy. We are not responsible for how you use the App or any ROM files you may use with it.

4. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Only use ROM files for games you legally own
  • Not use the App to violate any laws or regulations
  • Not reverse engineer, decompile, or disassemble the App
  • Not remove or alter any copyright notices or proprietary markings

5. Intellectual Property

5.1 App Ownership

The App, including its design, code, and documentation, is owned by us and is protected by copyright and other intellectual property laws.

5.2 Third-Party Components

GoGBA uses the following open-source components:

  • libretro mGBA core: Licensed under the Mozilla Public License (MPL) 2.0. See the App's license page for details.
  • RCheevos: Licensed under the MIT License. See the App's license page for details.
  • RetroAchievements Documentation (ra_docs): Licensed under the GNU General Public License (GPL) 3.0.
  • Flutter framework: Licensed under the BSD 3-Clause License.
  • Other open-source dependencies as listed in the App's license information.

5.3 Game Content

Game ROMs, artwork, music, and other game content are the property of their respective copyright holders. We claim no ownership over any game content.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

  • The App will be error-free or uninterrupted
  • All ROM files will work correctly with the App
  • Save files will never be lost or corrupted
  • The App will meet your specific requirements
  • Cloud Save will be continuously available; it depends on third-party services (Google Drive, iCloud) which may change, be interrupted, or discontinued
  • AI Screen Translation depends on third-party AI services (Google); translations may be inaccurate, incomplete, or unavailable, and service availability may change
  • AI Screen Translation may be subject to usage limits (including limits loaded via remote configuration) that can change from time to time

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

8. Data and Save Files

While we implement measures to protect your save data, we cannot guarantee that save files will never be lost or corrupted. You are responsible for backing up your save files regularly.

Cloud Save: When you enable Cloud Save, your save files are stored by third-party providers (Google Drive or iCloud). We are not responsible for the availability, reliability, or data integrity of these services. We recommend maintaining local backups of your save files. You use Cloud Save at your own risk.

AI Screen Translation: If you use this optional feature, screen images are processed by Google as described in our Privacy Policy. We do not guarantee translation quality, fitness for a particular game, uninterrupted access to the underlying AI service, or any particular usage quota; applicable limits may be updated remotely. You use AI Screen Translation at your own risk.

9. In-App Purchases

Premium, AI Screen Translation, and other in-app purchases are processed by Apple (App Store) or Google (Google Play). Refunds are governed by the respective platform's policies. All purchases are final sale except as required by applicable law. We do not process payments directly and have no control over platform refund or billing procedures.

10. Modifications to the App

We reserve the right to modify, update, or discontinue the App at any time without prior notice. We are not obligated to provide updates or support for any particular version of the App.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
